A. Legal Recognition & Electronic Record

This document is an electronic record published in accordance with the provisions of the Information Technology Act, 2000 and the rules framed thereunder, as well as the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020 (as amended). This electronic record is generated by a computer system and does not require any physical or digital signatures.

B. Publication & Regulatory Framework

This document is published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, requiring the publication of rules, regulations, Privacy Policy, and Terms of Use for access or usage of the website https://superstree.com (hereinafter referred to as the “Platform” or “Website”).

D. Contractual Agreement & User Consent

Your use of the Platform and the purchase of any apparel, suit sets, kurtas, or related services (collectively, the “Services”) is governed by these Terms and Conditions (“Terms of Use”), together with our incorporated Privacy Policy, Return, Refund & Cancellation Policy, and Shipping Policy.

ACCESSING, BROWSING, CREATING AN ACCOUNT, OR PLACING AN ORDER INDICATES YOUR UNCONDITIONAL ACCEPTANCE OF THESE TERMS. PLEASE READ THEM CAREFULLY BEFORE TRANSACTING.

E. Definitions

For the purposes of these Terms, “You”, “Your”, “Customer”, or “User” refers to any legal or natural person competent to contract under the Indian Contract Act, 1872 who browses the Platform or purchases products offered by Super Stree.

F. Eligibility to Contract

Use of the Platform is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Act (including minors under 18 years of age or un-discharged insolvents) are not eligible to register or transact independently.

G. Account Security & User Responsibilities

• You agree to provide true, current, and complete personal, shipping, and billing information during checkout and account creation.
• You are solely responsible for maintaining the confidentiality of your account credentials and OTPs, and accept full responsibility for all activities conducted under your registered account.

H. Pricing, Discounts & Anti-Dark Patterns

• All-Inclusive Pricing: All prices displayed on product pages are denominated in Indian Rupees (INR) and are inclusive of Goods and Services Tax (GST) and mandatory packaging fees.
• Prior Price Transparency: In strict compliance with the Central Consumer Protection Authority (CCPA) Guidelines for Prevention of Dark Patterns (2023) and the Consumer Protection (E-Commerce) Rules (as amended in 2026), any crossed-out reference price or advertised discount represents either the genuine Maximum Retail Price (MRP) or the lowest price at which the garment was offered during the preceding 30 days.
• No Hidden Drip Pricing: We do not inject hidden convenience fees, auto-checked insurance boxes, or undisclosed mandatory charges at the final payment step.

I. Product Descriptions, Handcraft Nuances & Color Disclaimers

• Handcrafted Textile Nuances: Many Super Stree garments utilize handblock printing, traditional weaving, embroidery, and natural dyes. Slight variations in stitch, print placement, motifs, and dye shades are natural characteristics of ethnic garments and do not qualify as manufacturing defects.
• Digital Color Variations: Garment photographs are captured in professional studio lighting. Display color settings vary across smartphone screens and monitors (e.g., AMOLED, Retina, sRGB). Minor perceived differences in fabric shade between your screen and the physical product are acknowledged by the customer and shall not be deemed a defect or misrepresentation.

J. Commercial Protections: Returns, Wardrobing & Fraud Prevention

To maintain accessible pricing and protect our artisans against commercial exploitation and abusive return practices, the following rules strictly apply:

• Strict 3-Day Return Window: All return, exchange, or size-replacement requests must be formally initiated within 3 (three) calendar days from the date of confirmed delivery as tracked by our courier partners. Requests submitted after 3 days are void.
• Anti-Wardrobing & Security Tags: Super Stree garments may arrive with an external tamper-evident brand/security tag attached. If this tag is removed, torn, retagged, or missing, the return is immediately void. Garments showing any signs of having been worn to events, ironed, perfumed, deodorized, washed, or altered will be rejected without refund.
• Mandatory Unboxing Video for Defect / Damage Claims: If a customer claims that an item was delivered damaged, defective, or with missing pieces, the customer must notify Super Stree within 48 hours of delivery and submit a continuous, unedited unboxing video clearly displaying the intact shipping label, outer packaging condition, and the discovered defect. Claims submitted without photographic/video evidence may be rejected.
• Doorstep Delivery Refusals & RTO Deductions: If a customer places an order and subsequently refuses delivery at the doorstep without prior cancellation notice, or fails to accept delivery after 3 courier attempts, Super Stree reserves the right to deduct forward and return logistics charges from any refund issued.
• Suspension of Cash on Delivery (COD) for Serial Rejecters: Super Stree actively tracks Return-to-Origin (RTO) frequencies. We reserve the absolute right to disable Cash on Delivery (COD) facilities, require upfront partial non-refundable booking advances, or terminate accounts exhibiting chronic delivery refusals.
• Product Substitution & Legal Prosecution: Returning a different item, substituted garment, counterfeit, or empty box is a criminal offense under the Bharatiya Nyaya Sanhita, 2023 (BNS). Super Stree vigorously investigates fraudulent returns, retains all shipping weigh-ins and packaging CCTV records, and will initiate civil recovery and police complaints against fraudulent actors.

K. Payments & Financial Security

• Payments on the Platform are processed through certified, PCI-DSS compliant payment aggregators (PhonePe Payment Solutions) supporting UPI, Cards, NetBanking, and authorized wallets.
• Super Stree does not store customer CVVs, card PINs, or net banking passwords. You agree to use your own lawfully held payment instruments.

L. Intellectual Property Rights

All content published on this Platform—including trademarks, brand logos, product photography, editorial copy, site design, graphic banners, and look-and-feel—is the exclusive intellectual property of Super Stree. Any unauthorized reproduction, scraping, hotlinking, or commercial re-use of our imagery or branding is strictly prohibited and subject to legal prosecution under the Copyright Act, 1957 and Trademarks Act, 1999.

M. User Conduct & Platform Restrictions

You agree not to:

• Use automated bots, scrapers, or spiders to harvest product details, images, or pricing.
• Introduce malicious software, viruses, or Trojan horses designed to compromise Platform security.
• Post defamatory, abusive, obscene, or unlawful comments in product reviews or public feedback.

N. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Super Stree, its founders, and employees shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use or inability to use the Platform. Our total aggregate liability for any proven claim arising under a transaction shall not exceed the actual net invoice amount paid by you for the specific garment giving rise to the dispute.

O. Force Majeure

Neither party shall be held liable for failure or delay in performance caused by circumstances beyond reasonable control, including natural calamities, floods, extreme weather, strikes, courier network disruptions, government restrictions, or nationwide telecommunication breakdowns.

P. Statutory Grievance Redressal Mechanism

In accordance with Rule 5(2) of the Consumer Protection (E-Commerce) Rules, 2020 (as amended) and the Information Technology Act, 2000, Super Stree provides a formal grievance redressal mechanism:

• 48-Hour Acknowledgment: Consumer complaints and legal notices will be formally acknowledged within 48 hours with a unique grievance ticket number and an official copy of the complaint as recorded.
• 30-Day Disposal: Grievances will be redressed and resolved within 30 calendar days (1 month) from the date of formal receipt.

Q. National Consumer Helpline (NCH) Convergence

In adherence to the Consumer Protection (E-Commerce) (Amendment) Rules, 2026, consumers have the statutory right to escalate unresolved grievances directly to the Government of India’s National Consumer Helpline (NCH). Consumers can contact the NCH by calling toll-free 1915 or visiting https://consumerhelpline.gov.in/.

R. Governing Law & Legal Jurisdiction

These Terms of Use shall be governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India. Any legal dispute, suit, claim, or court proceeding arising out of or in connection with these Terms or orders placed on the Platform shall be subject to the exclusive jurisdiction of the competent judicial courts in Palghar, Maharashtra, India.

S. Modifications & Severability

We reserve the right to revise these Terms of Use to reflect evolving legal or operational standards. Updates take effect immediately upon publication. If any clause of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining clauses shall continue in full force and effect.
